Terms and Conditions of Sale

These Terms and Conditions of Sale define the rights and obligations of the parties and apply to all orders and transactions made through the Wateke Shop website and online store: www.watekeshop.com.
By placing an order on our website, you acknowledge that you have read and accepted these Terms and Conditions of Sale. The fact that these terms are not written in your native language does not prevent them from applying.
Anyone making a purchase on the website declares that they have the legal capacity to enter into a contract. Anyone under 18 must have permission from a parent or legal representative.
In these terms, “Wateke”, “we”, “our” or “us” refers to the seller and operator of the shop. “You” or “customer” refers to the buyer or user of the website.
We reserve the right to amend these Terms and Conditions of Sale. Any amendment will apply only to orders placed from the date on which it takes effect.
1. Prices and availability
1.1 Prices
All prices displayed on our website are in euros (EUR). Applicable taxes are included where required by law. The total price applicable to your order, together with any delivery charges, is shown before you confirm your purchase.
1.2 Delivery charges
Delivery charges are shown separately before the order is confirmed. Standard delivery is free for purchases of €67 or more, unless otherwise stated on the website or during checkout.
1.3 Price changes
Wateke reserves the right to change its prices at any time. However, the price applicable to an order is the price displayed when the customer confirms it.
1.4 Obvious pricing errors
If there is an obvious error in a displayed product price, we reserve the right to correct it. If an order has already been placed, we will inform you. You may then confirm the order at the corrected price or cancel it and receive a refund of any amount already paid.
1.5 Product availability
Products are offered subject to availability. Wateke reserves the right to change its range, withdraw products or make them temporarily unavailable.
2. Orders
2.1 Placing an order
You can place an order directly on www.watekeshop.com by selecting the products you want and following the checkout process.
2.2 Confirmation
After placing your order, you will receive a confirmation containing your order number and other relevant details.
2.3 Formation of the contract
Your order constitutes a request to purchase the selected products. The sales contract becomes final when we send you an order confirmation by email. If we are unable to accept your order, we will inform you as soon as possible.
2.4 Unavailability
If a product becomes unavailable after your order has been confirmed, we will inform you and, depending on the circumstances, offer:
- a refund;
- an alternative product; or
- a new estimated delivery date.
2.5 Refusal or cancellation of an order
Wateke reserves the right to refuse or cancel an order in cases including:
- fraud or reasonable suspicion of fraud;
- a payment incident;
- clearly incorrect delivery information;
- a dispute concerning a previous order;
- product unavailability.
Any amount already paid for a cancelled order will be refunded where applicable.
3. Payment
3.1 Payment methods
Payment must be made using one of the methods offered during checkout.
3.2 Secure payments
Payments are processed by secure third-party payment providers. Wateke does not directly store your complete bank card details.
3.3 Retention of title
Products remain the property of Wateke until the order price has been paid in full.
4. Delivery
4.1 Delivery address
Products are delivered to the address supplied by the customer when placing the order. The customer is responsible for the accuracy of this information. Additional costs caused by an incorrect or incomplete address supplied by the customer may be charged to the customer.
4.2 Delivery areas
Wateke currently delivers to Benelux, Germany and France. For delivery to another country, contact us at client@watekeshop.com.
4.3 Timescales
Orders for products in stock are generally prepared within 24 hours on business days. The usual delivery time is 1 to 5 business days, unless a different timeframe is stated during checkout. These timescales are estimates.
4.4 Tracking
Where the delivery service allows, the customer receives a tracking number or link.
4.5 Delivery delays
If there is a significant delay, we will inform you as soon as possible. Consumers’ rights in the event of delayed or failed delivery remain fully applicable under Belgian and European law.
4.6 Transfer of risk
For consumer sales, the risk of loss of or damage to the product passes to the customer when the customer, or a third party appointed by the customer other than the carrier, takes physical possession of the product.
5. Right of withdrawal and returns
5.1 Wateke return period
For online purchases, consumers have the statutory right of withdrawal applicable in the European Union. In addition to that statutory period, Wateke allows you to notify us that you wish to return a product up to 20 calendar days from the day after you receive it.
5.2 Return request
To exercise your right of return, contact us at client@watekeshop.com and include your order number.
5.3 Time allowed to return the product
After notifying us of your decision to withdraw, you have 20 calendar days to return the product.
5.4 Condition of returned products
The product must be returned:
- unworn, except for reasonable inspection;
- undamaged;
- complete;
- with any accessories;
- in its original packaging where reasonably possible.
The consumer may be liable for any reduction in the product’s value caused by handling beyond what is necessary to establish its nature, characteristics and proper functioning.
5.5 Return costs
The direct cost of return is paid by the customer when exercising the right of withdrawal because they have changed their mind. Wateke pays the return cost when the product is found to be defective or non-conforming, or when we made an order-preparation error.
5.6 Sending the return
We recommend using a tracked delivery service. The customer is responsible for the returned parcel until Wateke receives it, unless Wateke arranges the return transport directly.
5.7 Personalised products
The right of withdrawal does not apply to products that are made to measure, clearly personalised or made to the customer’s particular specifications, except where they are defective or non-conforming.
6. Refunds
6.1 Amount refunded
When a valid right of withdrawal is exercised, Wateke refunds the amounts due in accordance with applicable law. This includes the price of the products concerned and, where required by law, the standard delivery charge initially paid. Additional costs resulting from the customer choosing a more expensive delivery method than our standard delivery are not refunded.
6.2 Refund period
The refund will be made no later than 20 days after the date on which you informed us of your decision to withdraw. We may withhold the refund until we receive the returned products or receive evidence that the products have been sent, whichever occurs first.
6.3 Payment method
Where possible, the refund is made using the same payment method used for the original transaction.
7. Statutory guarantee and conformity
7.1 Statutory guarantee
Products sold by Wateke benefit from the statutory guarantee of conformity applicable to consumers under Belgian and European law. This guarantee is independent of any commercial guarantee Wateke may offer.
7.2 Duration
New products benefit in particular from a two-year statutory guarantee, in accordance with applicable law.
7.3 Conformity
Our products must match the description provided when the order was placed and possess the qualities a consumer may reasonably expect from products of the same type.
7.4 Handcrafted nature
Some pieces offered by Wateke are handmade. Slight variations in colour, texture, finish or detail may therefore occur between pieces. Small variations inherent in handmade production do not necessarily constitute a defect or non-conformity.
7.5 Defective or non-conforming product
If a product has a defect or non-conformity covered by the statutory guarantee, the consumer has the remedies provided by applicable law, which may include repair, replacement, a price reduction or, in the circumstances provided by law, a refund.
8. Intellectual property
8.1 Protected content
All content on the Wateke Shop website, including trademarks, logos, designs, photographs, illustrations, text, videos, product names, graphic elements and trade names, is protected by applicable intellectual-property rights.
8.2 Use
Without prior written permission, you may not copy, reproduce, modify, distribute, publish or commercially exploit content belonging to Wateke or its respective rights holders.
9. Liability
Wateke makes every effort to provide accurate and up-to-date information on its website. However, unintentional errors or omissions may occur. When we are informed of an error, we make every effort to correct it promptly.
Wateke cannot be held liable for damage resulting from use of the website contrary to these Terms and Conditions of Sale or applicable law. Nothing in these terms is intended to exclude or limit a consumer’s mandatory statutory rights.
The website may also contain links to third-party websites or services. Wateke has no control over their content and cannot be held liable for their availability or practices.
10. Force majeure
Wateke cannot be held liable for a delay or failure to perform its obligations where this results from an event beyond its control that could not reasonably have been foreseen or controlled. This may include natural disasters, fire, strikes, major transport-network disruption, major telecommunications failures, decisions by public authorities or other events that meet the legal definition of force majeure.
In such circumstances, we will inform you as soon as possible and make every effort to limit the consequences for your order.
11. Complaints and customer service
If you have a question or complaint about your order, our products or our services, contact us at client@watekeshop.com. We aim to respond to and handle complaints within a reasonable time and, where possible, within 7 business days of receiving them.
12. Personal data and privacy
The processing of your personal data is governed by our Privacy and Cookies Policy.
13. Governing law and disputes
These Terms and Conditions of Sale are governed by Belgian law, subject to any mandatory consumer-protection provisions applicable in the consumer’s country of residence.
If a dispute arises, please contact us first so that we can try to find an amicable solution. If any provision of these Terms and Conditions of Sale is found invalid or unenforceable, the remaining provisions remain fully effective. Electronic communications, order confirmations and other electronic records may be used as evidence in accordance with applicable law.

Wateke Shop is operated by HOBE BENELUX, established in Belgium.
