These general terms and conditions define the rights and obligations of the parties and apply to all orders and sales transactions made via the website and webshop of Wateke Shop: www.watekeshop.com
By placing an order or otherwise using the website, you confirm that you have read, understood and agree to these Terms and Conditions. If these terms are not written in your mother tongue, this does not exempt you from their application.
Users who wish to make a purchase on this website declare that they have full legal capacity to do so (minimum age: 18 years, or with consent of a parent/legal guardian).
In what follows, “Wateke”, “we”, “us” refers to the seller and owner of this website. “You” refers to the buyer or user.
We reserve the right to amend these terms. Any changes will only apply to orders placed on or after the date of the change.
1. Prices and Availability
1.1 All prices displayed on the website are in euro (EUR) and are without VAT, unless stated otherwise.
1.2 Shipping costs are charged separately and are borne by the buyer, unless free shipping or other conditions are clearly mentioned on the website or at checkout. Freeshipping starts at 67EUR.
1.3 Prices and other statements on the Wateke website are non-binding, except where a validity period is explicitly indicated in writing.
1.4 If an item is mistakenly shown with an incorrect price on the webshop, we reserve the right to correct the price. You will then have the right to cancel the order, and any amount already paid will be refunded.
1.5 We do not guarantee that all products advertised on the Wateke webshop are available at all times. We reserve the right, without prior notice, to change products, remove them from the assortment, or make them temporarily unavailable.
2. Placing Your Order
2.1 You may place an order by completing the order form on www.watekeshop.com and clicking the relevant submission button.
2.2 When you place your order, you will receive an order number.
2.3 By placing an order, you make an offer to purchase the selected products under these Terms and Conditions. We may accept or decline this offer at our discretion.
2.4 Your order is considered accepted, and the contract becomes binding, once we send you an order confirmation email. If we cannot accept your order, we will attempt to contact you by email (and, where possible, by phone).
2.5 Wateke cannot be held liable for any losses incurred as a result of the unavailability of an item.
2.6 In case of late payment, non-payment or issues related to previous orders, Wateke reserves the right to suspend or cancel the contract.
3. Payment
3.1 Payment must be made using one of the methods available on the website at checkout.
3.2 We work with secure, third-party payment providers to process your payment.
3.3 Goods remain the property of Wateke until they have been paid for in full.
4. Delivery
4.1 We deliver the products indicated on your order confirmation to the delivery address you provide. Wateke cannot be held liable for errors made by the customer in the delivery or billing address, or for delays or failures in delivery caused by such errors.
4.2 Title and risk of loss pass to you once the products are delivered to the address indicated in your order confirmation.
4.3 For products in stock, orders are usually prepared within 24 hours (working days) and delivered within the indicative timeframe shown at checkout. These delivery times are indicative only and not binding.
4.4 Deliveries are generally made on working days (Monday to Friday, excluding public holidays). Any specific local delivery options or offers (such as free delivery in certain areas) will be clearly mentioned on the website if applicable.
4.5 If a product is not in stock, you will be informed by email of a new expected delivery date. If you do not agree with the new date, you may cancel the order or choose an alternative product. In case of cancellation, the amount already paid will be refunded; in case of an alternative product, a new invoice or credit note will be issued.
4.6 If we are unable to deliver within the agreed or indicated timeframe, we will inform you before the term expires. If we still cannot deliver, you are entitled to cancel the order and receive a refund within 30 days of cancellation.
4.7 We cannot be held liable for any consequential damage due to late delivery or non-delivery by the courier service we use.
5. Right of Withdrawal and Returns
5.1 As a consumer within the EU/EEA, you have a right of withdrawal. In addition, Wateke allows returns within 20 calendar days after receipt of the product, provided the conditions below are met.
5.2 Returned products must be in new, unused condition, in their original packaging, in perfect condition, and accompanied by proof of purchase (e.g. invoice or order confirmation). If the sender cannot be identified or the conditions are not met, the return may be refused.
5.3 The direct costs of returning products (such as shipping costs) are borne by the consumer and are their responsibility.
5.4 Wateke recommends using a trackable shipping method for returns. Wateke is not responsible for returns that are lost, stolen or damaged during shipment.
5.5 The refund will be made within 30 days of receipt and inspection of the returned goods by Wateke, provided all conditions above are met. The refund will never exceed the amount actually paid by the customer for the product(s) in question.
6. Guarantee and Conformity
6.1 Without prejudice to your legal rights as a consumer, our products are covered by the legal guarantee applicable under Belgian and EU consumer law.
6.2 We guarantee that the products will correspond to your order and meet your normal expectations, taking into account the specifications of each product.
6.3 Wateke is not liable for minor deviations in colour, finish or details that are inherent to handmade or artisanal products, nor for technical data and information provided by manufacturers or suppliers.
6.4 If a product is found, with valid proof, not to conform to the normal standards of the product or to contain a hidden defect, you are entitled to repair, replacement or refund according to applicable consumer legislation.
7. Intellectual Property Rights
7.1 The content of this site, including but not limited to trademarks, logos, designs, texts, images, product names and company names, is protected by intellectual property rights and belongs to Wateke or third-party rights holders.
7.2 You may not copy, reproduce, distribute, publish, modify or create derivative works from any content of this website without prior written consent from Wateke or the relevant rights holder.
8. Limitation of Liability
8.1 The information on the website is of a general nature and is not adapted to personal or specific circumstances, and therefore cannot be considered personal, professional or legal advice.
8.2 Wateke makes reasonable efforts to ensure that the information on the website is complete, accurate and up to date. However, inaccuracies or omissions may occur. When notified, we will make every effort to correct them as soon as possible.
8.3 Wateke cannot be held liable for any direct or indirect damage resulting from the use of the information on this site or from the use or unavailability of the website, including but not limited to: loss of data, loss of profit, work interruptions, or damage to programs, data or equipment.
8.4 The content of the site (including links) may be changed, adapted or supplemented at any time without prior notice.
8.5 The website may contain links or references to third-party websites. The presence of these links does not imply any approval of their content. Wateke has no control over these websites and cannot be held liable for any damage arising from their use.
9. Force Majeure
9.1 In the event of force majeure, Wateke is not obliged to fulfil its obligations. In such a case, we may suspend our obligations for the duration of the force majeure or permanently terminate the contract.
9.2 Force majeure includes any circumstance beyond our reasonable control which prevents the performance of our obligations, in whole or in part, such as (non-exhaustive list): strikes, fire, business interruption, power failure, disruptions in telecommunications or internet, malfunction of the website, late or non-delivery by suppliers or engaged third parties.

12.1 Belgian law applies to these Terms and Conditions and to all disputes relating to the use of the Wateke website and webshop.
12.2 The invalidity, nullity or unenforceability of any provision of these Terms shall not affect the validity and enforceability of the remaining provisions.
12.3 The parties accept that electronic communication between them has the legal value of written evidence.
12.4 For any dispute arising from the use of the website or from any purchase, the courts of Antwerp (Belgium) have exclusive jurisdiction.
